JowWow Hosting Terms of Service

JowWow provides web hosting services to subscribers around the world. The following terms of service are designed to provide the highest level of service available.

ACCEPTANCE OF TERM
This agreement sets out the terms and conditions upon which we will provide the products and services detailed on our Website to you. Your use of our services means that you accept, and agree to abide by all the terms set out here

As a precondition and requirement to use the services available via JowWow, you, for yourself and for the company or other person(s), if any, you represent ("Subscriber" or "Subscribers", as applicable), hereby accept and agree to be legally bound by these Terms of Service ("Terms"). These Terms are effective immediately between the Subscriber and JowWow. Each Subscriber is subject to these Terms, and by using JowWow’s services, network and/or systems (collectively the "Services"), Subscriber agrees to be legally bound by and subject to all terms and conditions contained in these Terms, including as well all usage policies and other policies herein. To the extent not inconsistent therewith, these Terms are also incorporated into the individual service agreement, if any, of each Subscriber. These terms apply to all Services provided by JowWow to you during the Term. Certain provisions of this TOS may not apply to you based on your Order.

The below list is inclusive and not exhaustive
(a) upload, post, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy (up to, but not excluding any address, email, phone number, or any other contact information without the written consent of the owner of such information), hateful, or racially, ethnically, or otherwise objectionable;

(b) harm minors in any way;

(c) impersonate any person or entity, including, but not limited to, a JowWow official, forum leader, guide, or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;

(d) forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;

(e) upload, post, or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

(f) upload, post, or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary rights of any party;

(g) upload, post, or otherwise transmit unsolicited commercial email or "spam." This includes unethical marketing, advertising, or any other practice that is in any way connected with "spam," such as (a) sending mass email to recipients who haven't requested email from you or with a fake return address, (b) promoting a site with inappropriate links, titles, descriptions, or (c) promoting your site by posting multiple submissions in public forums that are identical;

(h) upload, post, or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;

(i) interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the Service;

(j) intentionally or unintentionally violate any applicable local, state, national, or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;

(k) "stalk" or otherwise harass another;

(l) promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, without limitation, providing instructions on how to assemble bombs, grenades, and other weapons or incendiary devices;

(m) offer for sale or sell any item, good, or service that (a) violates any applicable federal, state, or local law or regulation, (b) you do not have full power and authority under all relevant laws and regulations to offer and sell, including all necessary licenses and authorizations, or (c) JowWow determines, in its sole discretion, is inappropriate for sale through the Service provided by JowWow;

(n) use the Service as a forwarding service to another Web site;

(o) exceed the scope of the Service that you have signed up for; for example, accessing and using the tools that you do not have a right to use, or deleting, adding to, or otherwise changing other people's comments or content as a Guest. If any user is reported to be in violation with the letter or spirit of these terms, JowWow retains the right to terminate such account at any time without further warning.

(p) Account Holder having a Website on one of JowWow's Services.
(q) Guests invited by an Account Holder (a "Guest") to post comments or add contents. 
(r) Partners who have their client's website hosted at JowWow.

JowWow may alter this TOS at any time without notification to you. However, the current TOS is always available on JowWow's website. Your sole remedy in the event that you do not agree to those amendments is to provide JowWow with written notice of termination as within 10 business days of the date of the amendment. Only a JowWow officer may alter this TOS. No agent of, or person employed by or under contract with JowWow, has any authority to alter or vary this TOS in any way. No oral explanation or oral information given by any party shall alter the interpretation of this TOS.

In addition to this TOS, all domain name registrations are subject to the terms and conditions of any registrar JowWow may use to fulfill the Order and the rules and regulations of the relevant registrar. As a condition of this TOS, you agree to be bound by the rules and regulations and dispute resolution policies applicable to each domain name applied for on your behalf. Content
All services provided by JowWow. are to be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or Local law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, material that jeopardizes national security, or material protected by trade secret or other laws. The subscriber agrees to indemnify and hold harmless JowWow., from any claims resulting from the subscriber's use of JowWow's services which damages the subscriber or any other party.
jowwow.net provides each Account Holder with a website on jowwow's Internet Property ( the server ). Each website has a limited disc space based on the type of account purchased. The Service also includes tools that enable Account Holders and their Guests to build a Website using useful content mangagement tools. The type and number of tools you may use depend on the type of account you have and your status as an Account Holder or a Guest. Unless explicitly stated otherwise, any new features that augment and/or enhance the current Service, including the release of new jowwow.net tools and resources, shall be subject to the TOS. In order to use the Service, you must obtain access to the World Wide Web, either directly or through devices that access Web-based content, and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device.

Examples of prohibited content or links include (but are not limited to):

• IRC Software
• Pirated software
• Hacking sites, programs or archives
• Warez Sites
• Distribution of music files or any other material in which the account holder does not own the copyright.
• Pornography

JowWow. will be the sole arbiter as to what constitutes a violation of this provision. Content that does not meet these standards will be removed without prior notice to the subscriber.

Housing of any of the following files is considered a violation of the terms of service:

IRC - We currently do not allow IRC, Egg Drops, BNC, or IRC bots to be operated on our servers or network. Files with references to IRC or any likeness thereof are prohibited.

Proxies - We do not allow proxy servers of any kind, whether for personal or business use. Files with references to any proxy or likeness thereof are prohibited.

PortScanning - We do not allow any kind of port scanning to be done on or from our servers or network.

Commercial Advertising - Email

• Spamming, i.e. the sending of unsolicited email, from any JowWow server or any server located on the JowWow network is STRICTLY prohibited. JowWow will be the sole arbiter as to what constitutes a violation of this provision. This also includes Opt-in Opt-out mail programs and mail that either directly or indirectly references a domain contained within an account at JowWow.
• Running Unconfirmed Mailing Lists. Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run by JowWow customers must be Closed-loop ("Confirmed Opt-in"). The subscription confirmation message received from each address owner must be kept on file for the duration of the existence of the mailing list. Purchasing, selling, or utilizing lists of email addresses from 3rd parties for mailing to or from any Liquidweb Inc.-hosted domain, or referencing any JowWow account, is prohibited.
• Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks is prohibited.
• Email address cultivating, or any unauthorized collecting of email addresses without prior notification of the email address owner is strictly prohibited.
• Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org is prohibited.
• All commercial email marketing companies must adhere to the Controlling the Assault of Non-Solicited Pornography And Marketing (CAN-SPAM) Act of 2003. In addition such companies are prohibited the sending of bulk mail from "disposable domain names" with whois privacy protection.

Server Abuse- Any attempts to undermine or cause harm to a JowWow server or subscriber of JowWow is strictly prohibited including, but not limited to:

• Logging into a server or account that you are not authorized to access
• Accessing data or taking any action to obtain services not intended for you or your use
• Attempting to probe, scan or test the vulnerability of any system, subsystem or network
• Tampering, hacking, modifying, or otherwise corrupting or breaching security or authentication measures without proper authorization
• Transmitting material that contains viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines or engines with the intent or effect of damaging, destroying, disrupting or otherwise impairing a computer's functionality or the operation of the System
• Interfering with, intercepting or expropriating any system, data or information
• Interfering with service to any user, host or network including, without limitation, by means of overloading, "flooding," "mailbombing," or "crashing" any computer system

You will be held responsible for all actions performed by your account whether it be done by you or by others.
All sub-networks of JowWow. and all dedicated servers must adhere to the above policies.

Bandwidth Measurement and Overage Fees
As of August 11, 2004 all bandwidth listings for Webmaster, Professional and Enterprise dedicated servers consist of the sum of incoming and outgoing bandwidth allowance. Incoming and outgoing bandwidth allowances are calculated on a 50/50 split of incoming to outgoing bandwidth based on the total bandwidth, therefore the incoming and outgoing bandwidth allowances are each half of the total listed bandwidth. Any bandwidth usage exceeding either the incoming or outgoing bandwidth total will be billed at the rate of $0.50 per GB over.

Dedicated Server Support
Basic support and maintenance of dedicated servers is provided at the discretion of JowWow. In the case of erroneous instances or support issues extending beyond what we determine to be within the realm of reasonable assistance, support is currently priced as follows:

• $50/hour

Prices posted on our billing pages shall always prevail in cases of descrepancy.

Scheduled Maintenance and Downtime
JowWow will use its commercially reasonably efforts to provide services 24 hours a day, seven days a week. Subscriber acknowledges that from time to time the services may be inaccessible or inoperable for various reasons, including periodic maintenance procedures or upgrades ("Scheduled Downtime"); or service malfunctions, and causes beyond JowWow's control or which are not reasonably foreseeable by JowWow including the interruption or failure of telecommunications or digital transmission links, hostile network attacks, or network congestion or other failures. JowWow will provide at least 48 hours advance notice to the subscriber for Scheduled Downtimes, and will use commercially reasonable efforts to minimize any other disruption, inaccessibility and/or inoperability of its web servers. JowWow has no responsibility for downtime resulting from a user's actions. Also, the 100% network uptime guarantee does not apply for shared accounts.

Refunds
Refunds will be posted for FULL months only, with the exception of plans including a 30 day money back guarantee (shared hosting only). Virtual Dedicated, Virtual Private, and Dedicated servers are not included for the 30 Day Money Back Guarantee. Notice of cancellation must be given before the month in question begins. Setup fee is NON refundable. $14.95 will be deducted from the money refunded if the user's domain was registered via JowWow.'s free domain registration method.

Any violation of JowWow.'s Terms of Service Agreement shall result in no refund.

Account Setup, Termination, and Billing:
The account will be charged on the day the order is processed, regardless of the account billing date. The account will not be charged again until the next month's billing cycle. Billing dates are recurring on the day the account was opened. All fees listed on our website are net of applicable taxes. You are responsible for all taxes and fees levied on the Service.

Check Orders: Accounts for subscribers who wish to pay by check will be setup when the check is deposited by JowWow.

Disabling of accounts due to overdue payment: Accounts will be disabled if payment is not received within 3 days of the invoice date. If your account has been disabled, you may be charged a reconnection fee of up to $50 in order to re-enable your account.

Termination of accounts due to overdue payment: If the account is not paid within 30 days of the invoice date, the account will be terminated and all information within the account will be deleted.

Cancellation Procedure: Valid proof of account ownership will be required to terminate an account. This includes, but is not limited to, billing information in the form of a partial credit card number or other payment information, or the billing password. Non-secure information, such as the contact email address or account billing address, is not sufficient as a security verification.

Free Domain Name Registration: JowWow may at times offer to register any available .com, .org, or .net domain for free upon creation of a new account. The free domain offer does not apply to existing accounts, or to orders that did not request the free domain registration at the time the order was placed.

Free registration is for the first year only, subsequent renewals are $15 per year that the domain is renewed for.

Courtesy Services for Customers
All services such as backup and Cpanel are provided for the courtesy of the subscriber. It is the sole responsibility of the subscriber to maintain the subscriber's own backup of any data. JowWow. is not responsible for lost data or for lost data due to third party software that is not maintained by JowWow. programming staff, nor for any sottware controleld by the customer.. (Cpanel is not associated with JowWow.)

Promotional Use
JowWow may refer to You, Your company, or your logo's for promotional purposes. Your company name, logos and the services that were provided to the customer by JowWow may be used in promotional materials, advertising, marketing releases, newsletter, public disclosures and on the JowWow website. This reference will be strictly limited to disclosure that JowWow has provided services to the company and will not contain any confidential, sensitive or proprietary information in such a reference. The reference will also not provide any personally identifiable information about the individual or technical information regarding the server configuration and design used by the customer at JowWow. However, JowWow may disclose any information requested by law enforcement or when compelled by court order, applicable laws or regulations.

Any work or professional services performed or provided by JowWow under this Agreement shall not be deemed .Work For Hire,. but JowWow shall grant a non-exclusive, non-transferable license to You, for the duration of this Agreement, its employees, affiliates, and third parties commissioned by JowWow.

Microsoft Software License Policy.
Microsoft, as well as JowWow company policy, does not allow mixing of Microsoft license ownership. For an example, a customer cannot use a JowWow purchased Windows Server license in conjunction with their own customer license of MSSQL or any other Microsoft Product. This is a violation of Microsoft's licensing policies. The customer would have to obtain all Microsoft licenses through JowWow. In some instances, we can allow the customer to supply all Microsoft licensed products, including the OS. However, all licenses must be provided by the customer and may not be mixed with JowWow licensed Microsoft products. Limitation of Damages
Recovery of damages from JowWow may not exceed the amount of fees it has collected on the account.

General
Terms Of Service are subject to change without any prior notification.

These Terms of Service are a legally binding contract between the subscriber and JowWow.

By opening an account, the subscriber agrees to the above-stated terms.

Anything not listed in the Terms of Service is open to interpretation and change by JowWow. administrators without prior notice.

All prices, with the exception of the 30-day money back guarantee, are nonrefundable and nonnegotiable.

The 30-day money back guarantee does not pertain to Virtual Dedicated and Full Dedicated server plans.

Any violation of these Terms of Service will result in termination of the account. JowWow. maintains the right to terminate accounts without prior notification.

We reserve the right to remove any account with 15 days prior notice.


BILLING DISPUTES
If you believe there is an error on your bill, you must contact us in writing. We each agree to work together in good faith to resolve any billing disputes. Your dispute must include sufficient facts for us to investigate your claims and be received by us not later than 5 days after the Invoice Due Date (Dispute Deadline). You waive your right to dispute any charges or Fees if you fail to meet the Dispute Deadline. If we find that your claim is valid, we agree to credit the account that is the subject of the dispute on your next bill. If you contact your credit card company, prior to notifying us of the dispute, and initiate a "chargeback" based on this dispute, and your charge back claim is past the Dispute Deadline, you will be charged a $50 investigation fee and a $50 reactivation fee. This fee compensates us for the investigation your credit card issuer requires us to conduct in order to demonstrate our right to payment. All your services may be suspended during bill disputes. To reactivate your services, you must pay the Fees due.


Indemnification
Customer agrees to indemnify and hold harmless JowWow its subsidiaries, their affiliates and each of their respective directors, officers, employees, shareholders and agents (each an "Indemnified Party") against any losses, claims, damages, liabilities, penalties, actions, proceedings, judgments, or any and all costs thereof (collectively, "Losses") to which an Indemnified Party may become subject and which Losses arise out of, or relate to the Agreement, Customer's use of the Products and Services, breach of any confidentiality obligation or any alleged infringement of any trademark, copyright, patent or other intellectual property right and will reimburse an Indemnified Party for all legal and other expenses, including reasonable attorneys' fees incurred by such Indemnified Party, in connection with investigating, defending, or settling any Loss, whether or not in connection with pending or threatened litigation in which such Indemnified Party is a party.

JowWow may from time to time, at the request of the CUSTOMER, be enlisted to perform server administration tasks on CUSTOMER hardware which is colocated at JowWow facilities. This service shall be referred to as "Remote Hands". Customer agrees to indemnify and hold harmless JowWow, its subsidiaries, their affiliates and each of their respective directors, officers, employees, shareholders and agents (each an "Indemnified Party") against any incidental damages caused to CUSTOMER hardware in the performance of JowWow remote hands server administration.


DUTIES
Subject to the terms and conditions of this agreement, JowWow shall provide the Services to the Customer.  While Jowwow may as a courtesy, offer to install software for a customer the responsiblity to do so, and to provide said software in a manner deemed acceptable by Jowwow is soley upon the customer.

REGISTRATION
In order to use the Service, you must have a valid JowWow ID. To be an Account Holder with your own website, you must provide JowWow with a credit card, billing and shipping information, and other information ("Registration Data"). Accounts Holder will choose a password and account designation for your website during the Service's registration process. If you are using the Service as a Guest, you must also go through the registration process and provide the registration data requested. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account.

You agree to (a) immediately notify JowWow of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session.

JowWow cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 4. In consideration of use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form, and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or JowWow has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, JowWow has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

Users under 18 years of age are required to have a parent or guardian review and complete the registration process.
While we do not permit pornographic material on our servers, some content may not be suitable for young viewers.

Privacy Policy
Registration Data and certain other information about you is subject to our Privacy Policy, the terms of which are incorporated into this TOS by reference.


OWNERSHIP OF WEBSITE ACCOUNT AND SECURITY
You are responsible for maintaining the security of your account and website, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the website, including those of your Guests. You agree to immediately notify JowWow of any unauthorized uses of the account or any other breaches of security. JowWow cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You acknowledge and agree that under no circumstances will JowWow be liable, in any way, for any acts or omissions by an Account Holder or a Guest, including any damages of any kind incurred as a result of such acts or omissions.

CONTENT AND CONDUCT RULES AND OBLIGATIONS
You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, goods, products, services or other materials ("Content") are the sole responsibility of the person from which such Content originated. This means that you, and not JowWow, are entirely responsible for all Content that you upload, post, transmit, or otherwise make available via the Service. JowWow does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content.

You understand that by using the Service, you may be exposed to Content that is offensive, indecent, or objectionable. Under no circumstances will JowWow be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, transmitted, or otherwise made available via the Service. You acknowledge that JowWow does not pre-screen Content, but that JowWow and its designees shall have the right (but not the obligation) in their sole discretion to refuse or move any Content that is available via the Service. Without limiting the foregoing, JowWow and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content submitted to JowWow. You acknowledge and agree that JowWow may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOS; (c) respond to claims that any Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of JowWow, its users and the public.

You understand that the technical processing and transmission of the Service, including your Content, may involve: (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

CONFIGURATION AND SUPPORT
The Services are provided to you as configured for our standard customer. In some cases, they may have the manufacturer's default settings. You bare ultimate responsibility to ensure that the Services are configured to meet your operational, privacy and security needs. Your hardware, software and any other items you deem necessary to use the Services must be compatible with the Services. We are not obligated to modify the Services to accommodate your use. You may not terminate an Order based on your inability to use the Services because such a use is incompatible with them. If your use of the Services damages the Services or Equipment, you will be charged for any repairs we need to make to the Services or Equipment. We may suspend your use of the Services until we determine whether your use of the Services has damaged the Services or Equipment.

bandwidth Only. You will ensure that neither you nor any of your End Users makes excessive or wasteful use of the Server to JowWow's detriment or that of JowWow's other customers. The terms "excessive" and "wasteful" are defined by our experience with similarly situated customers. This means that your use of our resources may not exceed that of similarly situated customers. Unlimited use applies to your use of web pages only (html, php, etc.), not for storage of movies, pictures or MP3 files. Specifically:

With regard to data traffic on Shared Hosting services, a Fair Use policy will apply. If the contents of your Space regularly generate more server traffic than is deemed acceptable by JowWow, to the detriment of other JowWow customers, JowWow shall issue a warning by email to you, at the address you provided to JowWow, in which JowWow requests that you remove the contents or upgrade to a more suitable package. Excessive traffic may be caused by abnormally high traffic on your web pages or by powerful software solutions which you have installed on the Space. Our warning will also contain the terms and conditions for the appropriate solution which is capable of handling your prevailing level of traffic. If you do not comply with this warning within 5 business days, JowWow reserves the right to terminate this TOS.

BACKUPS
Back Up Services are provided as is and are subject to all warranty disclaimers and limitations of liability set out herein. By purchasing services from us, including Back Up Services, you agree that you will maintain your own set of backups independent of those we maintain. If we provide data to you from a back up, it will be provided as raw data, and you may be required to reformat that data so that it reflects a prior configuration or use. Our only obligation is to restore your Space or Server to its operating condition. It is your obligation to restore your website.

We provide certain services designed to filter unwanted email. You acknowledge that use of the Services will likely result in the capture of some legitimate email and the failure to capture some unwanted email that may contain spam, phishing scams and email infected with viruses. We recommend that you implement additional levels of protection. Email that is captured by our filtering system is not subject to our TOS.. We act in good faith to back up data stored on your account once per week. These backups are intended for internal use only and are not related to any Back Up Services we may offer. It is your responsibility to back up data of your website and content, email messages, SQL databases and anything else you may store on the Space we provide you. We may determine that certain file extensions are not suitable for backup. Such file types include but are not limited to: iso; ace; arj; avi; bak; bin; bz; bz2; cab; car; cbr; ccd; cdr; cue; drw; exe; flv; gz; gzip; img; iso; jar; jmy; lbs; md; mid; midi; mov; mp2; mp3; mp4; mpa; mpeg; mpg; nrg; pae; pak; psb; psd; r00; r01; r02; r03; ram; rar; rm; rmf; sea; sub; tar; tar.gz; tgz; vob; wad; wav; wave; wma; wmv; zip. It is your obligation to verify whether particular files will be backed up.

ADDITIONAL SOFTWARE
With respect to any additional software that may be made available by JowWow in connection with the Service, if you elect to download or access such additional software, you understand that you may have to agree to additional terms and conditions before you use such software.

INTERNATIONAL USE
Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content.
